TRADEMARK

"Trade Mark" means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include shape of goods, their packaging and combination of colours

"Well-known trademark ", in relation to any goods or services, means a mark which has because so to the substantial segment of the public which use such goods and services such services that the use of such mark in relation to others goods or services would be likely to be taken as indication a connectionin the same course of trade or rendering of services between those goods or services and a person using the mark in relation to the first mentioned goods or services.

"Services" means service of any description which is made available to potential users and includesthe provision of services in connection with business of any industrial or commercial matters such as banking, communication, education, financing, insurance, chit fund, real estate, transport, storage, material treatment, processing, supply of electrical or other energy, boarding, loding, entertainment, amusement, construction, repair, converying of news or information and advertising.

" Mark " include a device, brand, heading, label, ticket, name, signature, word, letter, numeral, shape of goods, packaging or comdination of colours or any combination thereof.
